By participating in any activities promoted by YieldNest or accessed through www.yieldnest.finance (“the Website”) or any third party apps or websites including but not limited to the 'YieldNest Seeds Program' or any similar initiatives involving the acquisition of ‘Seeds’ (collectively referred to as "Programs"), the User acknowledges, understands, and agrees to the terms outlined herein. The User accepts that these Programs are designed for measuring participation and/or engagement with the educational content provided by the Website.

The User further acknowledges that Seeds, as determined by YieldNest or the Website from time to time, are non-transferable, do not constitute financial instruments, and are not collateralizable as financial securities. The User acknowledges and agrees that participation in the Programs does not constitute a promise, guarantee, or obligation by YieldNest to convert ‘Seeds’ into any financial instrument and/or financial security.

The User explicitly agrees that participation in these Programs and the acquisition of Seeds entail inherent risks and uncertainties, with no guarantees regarding the future value, utility, or functionality of Seeds. The User also agrees to indemnify and hold harmless YieldNest and its affiliates from any claims or liabilities arising from their participation in the Programs or misuse of Seeds. By utilizing the Website, the User indemnifies YieldNest and assumes full responsibility for complying with all applicable laws, regulations, rules, and obligations imposed by the relevant competent authorities with regard to the regulatory treatment of the Programs, Seeds and Website in the User’s respective jurisdiction(s), where the User resides, conducts business, or engages in activities related to the Website.

At YieldNest, we strongly uphold the principle of personal sovereignty. Accordingly this document has been prepared solely for the purpose of providing this information to empower the User to conduct its own research and make well-informed decisions.

Blockchain Network Risks

YieldNest interacts with various blockchain networks. Any malfunction, breakdown, or abandonment of such blockchains may have a material adverse effect on the Website and Programs. Advances in cryptography, or technical advances including but not limited to the development of quantum computing, could present risks by rendering ineffective the cryptographic consensus mechanism that underpins the blockchain. The smart contract concept, the underlying software, and software platforms, including blockchain networks, are still in an early development stage and unproven. Although unlikely, blockchains can be attacked, which may result in downtime, consensus split, long reorganization of the chain, 51 percent attack, or other adverse outcomes, each of which may lead to complete loss of your assets on such blockchain network.

Third-Party Smart Contract Systems

YieldNest may derive certain information from third-party smart contract systems, including blockchains, automated market-making (AMM) protocols, oracles, and decentralized exchange smart contract systems and related software in an automated manner, which means such information is not verified. As a result, such information may not be true, complete, timely, accurate, or sufficient. Furthermore, certain functions related to the Programs may be executed by third parties that may not act in a timely or reliable manner, or as expected or intended, or may fail to act, which can lead to inaccessibility of the functionality or partial or complete loss of your respective assets.

Protocol Risks

When interacting with the Website, you may be exposed to certain risks related to the operation and functioning of the protocols it interacts with. The protocols are complex, with many components and functional elements that are risky and experimental. YieldNest makes commercially reasonable efforts to ensure transactions are secure, but there is no assurance against theft of digital assets due to hacks, cyber-attacks, distributed denial-of-service attacks, errors, double-spend attacks, flash-loan attacks, economic attacks, volatility-based attacks, third-party manipulations, vulnerabilities, or defects in the platform or related software.

User Interface

Certain user interface elements or design decisions on the Website may be confusing, resulting in the execution of unintended actions or transactions.
